The same Israeli student that challenged Gordon received a terse email after class that same day from Gordon requesting that the student come see him at his office at an appointment two days later. The student arrived at Gordon's office and was surprised to see his Graduate Student Instructor (who directly grades the student) present as well. The student cordially greeted Gordon in Hebrew but did not receive the same warm greeting in return. Gordon then proceeded to berate the student for publicly embarrassing and offending him during class. He belittled the student by telling him that he (Gordon) had been teaching for longer than the student20had been alive and that he had never been embarrassed and offended like that before. Behind closed doors, intimidated by his professor yelling at him, and in the presence of the person who decides his grade, the student quickly apologized and hoped the matter was put to rest. Much to the student's dismay, in the next lecture Gordon attempted to clear his name and denounced the student's challenging questions as unfair and unfounded, while publicly humiliating the student. Gordon's Graduate Student Instructors further dissected the Israeli student's challenge in the class discussion sections, and referred to the student by name without his consent. Along with the history of scare-tactics used by Prof. Gordon in order to keep his classroom opposition quiet and disallowing any challenging of his anti-Israel positions...'

Pipes' May-7-2020 NYTimes article against Israel's possible annexation, highlighting a line, branding the words as "racist," by erroneously misrepresenting his words about "enemy" and its meaning in sentence; the same who tweeted (Feb-13-2020) that a settlement is a "crime against humanity" and (May-15-2020) no peace until ALL are returned to Palestine and (July-1-2020) retweeted a case about Israeli court evicting one particular illegal house occupied by an Arab as "ethnic cleansing."  ever mind Israel does it to Jewish residents, en-masse. The pair is so extreme, that even biased anti-Israel Amnesty International isn't "good enough", and in April 2015 wrote against Amnesty for daring to criticize Hamas' use of human shields. 


Not only is it obvious that were these two anti m-Israel ardent activists really care about human shields they would write against Arab-Palestinian ruling government in Gaza for its use of its own people in order to carry out attacks against civilians (Sderot kindergartens among others), but it's the audacity of using human shields theme in its overall anti Israel vilification campaign in their (years of) anti-Israel first, human shields writing second, but as a tool.

Over the past 50 days, more than 4,000 rockets have been shot at Israel from the Gaza Strip. Thousands of these rockets were launched from densely populated areas. Hamas is committing a double war crime — first by using Palestinian civilians as human shields and second by intentionally targeting innocent Israeli civilians.

Deadly rockets were fired daily from launch pads located in hospitals, mosques and schools in Gaza only to explode in homes, synagogues and kindergartens in Israel. While Israel has been using missile defence to protect its civilians, Hamas has been using civilians to protect its missiles.

Hamas deliberately embeds its military operations in residential areas with the clear intention of using its own people, including women and children, as protection. One does not have to look any further than Hamas’ own combat manual on urban warfare to see how the terror organization has institutionalized its disregard for human life. Its combat strategy guidelines explicitly instruct terrorists to use civilians as human shields. This is not a new tactic — it has been the modus operandi of Hamas each and every time it has waged hostilities against Israel.

Evidence of this criminal strategy is mounting and the examples are too numerous to count. Hamas has routinely fired from schools, playgrounds and hotels, as described below:

On 8 July, a rocket was fired from within the El’ Azhar Islamic College

On 14 July, an M-75 rocket was launched from a children’s playground located in the neighbourhood of Shuj a’iya

On 1 August, a rocket was fired from within the Al-Shati refugee camp, near the Al Mashtal hotel, where many journalists were staying

And, as if exploiting civilian infrastructure was not horrific enough, Hamas repeatedly called on the civilian population of Gaza to disregard Israeli warnings and threatened them not to evacuate the areas from which Hamas launched its attacks. Such statements were made on 10 July by the Palestinian Ministry of the Interior and on 15 July by the Head of the Hamas refugee department. Hamas also used its official media channels to actively encourage Palestinian civilians to act as human shields, turning Israel Defense Forces (IDF) warnings of impending strikes into opportunities for sacrificing their own civilians.

Perfidy represents an especially serious violation of the law of war, one even identified as a “grave breach” in Article 147 of Geneva Convention No. IV.

The critical legal effect of perfidy committed by Palestinian or Hizbullah terrorists – especially their widespread resort to “human shields” – is to immunize Israel from any responsibility for inadvertent counter-terrorist harms done to Arab civilians. Even if Hamas and Islamic Jihad and Fatah and Hizbullah did not deliberately engage in perfidy, any terrorist-created link between civilians and insurgent warfare would always give Israel full and unassailable legal justification for its defensive military actions. This is not to suggest that Israel would have carte blanche in its applications of armed force, but that the reasonableness of these applications would have to be appraised in the context of enemy perfidy.

To be sure, viewed against the background of extensive and unapologetic terrorist perfidy in both Gaza and Lebanon, Israel was certainly not guilty of “disproportionality”. Let critics of Israel recall that all combatants, including all insurgents in Gaza and Lebanon, are bound to comply with the law of war of international law. This requirement derives not only from what is known in jurisprudence as the “Martens Clause”, which makes its first appearance in the Preamble to the 1899 Hague Convention No. II on land warfare, but also from Article 3, common to the four Geneva Conventions of August 12, 1949. It is found also in the two protocols to these Conventions.

It is easy for those who are altogether unfamiliar with international law to lash out unfairly at Israel with charges of “disproportionality”. Yet, legal scholars must always understand the vital significance of context. Authoritative judgments under international law are not made in isolation from other pertinent factors. In this connection, it is apparent that any seemingly disproportionate use of force by the Israel Defense Forces in the Lebanon War of 2006 was actually the outcome of antecedent perfidy by its criminal enemies in both Gaza and Lebanon (terrorism is a codified crime under international law). Were it not for these egregious violations of the law of war by terrorist adversaries, Israel would not have been obliged to wage war in a fashion that inevitably creates civilian casualties..

EXECUTIVE SUMMARY. HAMAS’ USE OF HUMAN SHIELDS IN GAZA
Summary/Abstract: Hamas, an Islamist militant group and the de facto governing authority of the Gaza Strip, has been using human shields in conflicts with Israel since 2007. According to the Statute of the International Criminal Court (ICC), the war crime of using human shields encompasses “utilizing the presence of a civilian or other protected person to render certain points, areas, or military forces immune from military operations.” Hamas has launched rockets, positioned military-related infrastructure-hubs and routes, and engaged the Israeli Defense Forces (IDF) from, or in proximity to, residential and commercial areas. The strategic logic of human shields has two components. 

It is based on an awareness of Israel’s desire to minimise collateral damage, and of Western public opinion’s sensitivity towards civilian casualties. 

If the IDF uses lethal force and causes an increase in civilian casualties, Hamas can utilise that as a lawfare tool: it can accuse Israel of committing war crimes, which could result in the imposition of a wide array of sanctions. Alternatively, if the IDF limits its use of military force in Gaza to avoid collateral damage, Hamas will be less susceptible to Israeli attacks, and thereby able to protect its assets while continuing to fight. Moreover, despite the Israeli public’s high level of support for the Israeli political and military leadership during operations, civilian casualties are one of the friction points between Israeli left-wing and right-wing supporters, with the former questioning the outcomes of the operation.

Hamas has assembled a well-armed terror army in Gaza, equipped with tens of thousands of rockets, anti-tank guided missile launchers, mortar launchers, and other weapons. A network of tunnels runs under the Gaza Strip for the movement of Hamas terrorists, and residential buildings double as military command centers and rocket launch sites. Hamas continues to prioritize its force buildup program over the wellbeing of the Gazan people.
Hamas copied its warfare doctrine, which is based on the principle of operating from within the civilian population and thereby exploiting that population as human shields, from Hezbollah, adapting it to Gazan conditions. The two organizations cooperate on a number of levels.
